CGNET SUBSCRIPTION NOTICE AND TERMS & CONDITIONS

The terms and conditions stated below are subject to changes. CGNET reserves the right to change any terms, conditions, fees, expenses, or charges against consumer's service at any time. We also reserve the right to amend or discontinue the Service, temporarily or permanently. We shall provide the customers with prior notice of material changes via the customer registered E-mail / SMS / Calls. Customers may find the latest terms and conditions on our website link: www.cgnet.com.np. The customer stands responsible to check for any such notices. Customer continuing the subscription/service after the effects of any change is considered as customer’s acceptance.

1. GENERAL TERMS.

A. CGNET residential packages are only available for home-used purposes and not to be used for business purposes. CGNET reserves the right to terminate service if the customer is found doing so. CGNET does not encourage any billing to be made in the company name for residential packages.

B. Registration and Documentation: Customers must fulfill the following mandatory conditions: 

(i) 18 years and above.

(ii) Corporation or other legal entity duly formed (and incorporated if applicable) meeting all legal authority and power to accept this Agreement and acting through customer’s duly authorized representative.

The customer must submit the below documents. 

(i) If an individual, a copy of Citizenship/Passport/Driving License and two recent passport size photos 

(ii) If a corporation, a copy of Company Registration and PAN/VAT Registration. The customer must confirm that all information supplied to CGNET is accurate including name, address, and documents submitted. Customers are held responsible for keeping all registration data accurate and must contact CGNET to update any changes.

C. IP Address: Dynamic IP will be assigned to subscribers until and unless static or dedicated IP request from Subscriber.

D. The customer acknowledges its responsibility for its own internet security and privacy. The customers are strongly advised to install firewalls and anti-virus software for their own protection. Any damage, loss, cost, or claim which the customer may suffer or incur from any suspension or termination of the services for any reasons contemplated in the agreement.

E. CGNET’s network may only be used for lawful purposes supported by Nepal or foreign law. Act violating any Nepal law or foreign laws or regulations is prohibited such as copyright material, material legally judged to be threatening or obscene, or material protected by trade secret law. The customer shall solely bear all the consequences and responsibilities for any kind of illegal activities conducted via the internet.

F. The customer may not sell, lease, mortgage, transfer, assign or encumber such equipment. CGNET shall not be held responsible for any unlawful activities of the customer. Any consequences resulting from redistribution/illegal use shall be borne by the customer. CGNET reserves the right to deny or terminate service immediately if found.

G. Service Operational Limits/Force Majeure: Neither party shall be liable to the other under this Agreement for any failure in performance that is due to causes beyond its reasonable control, including, but not limited to, acts of nature, governmental actions, fires, and civil disturbances, interruption of power or transportation problems.

H. CGNET is committed to providing reliable and high-quality internet connectivity to the customer however, commits no warranties that any Service will be uninterrupted or error-free. The customer accepts all Services provided hereunder “as is” without warranty of any kind.

I. CGNET proposes latency and speed within its own network and access network through Fiber connectivity only. The speed Customer has marked up to is the ideal organize speed beneath ordinary working conditions. Real speeds might be less due to variables like upstream supplier limitations, web location particular issues, line quality & length, trade sort, quality of remote device, remove from server, Customer premises impedances, activity, number of device/users, Customer device performance, and hardware and computer program. CGNETs benefit is planned to supply Customer with the most noteworthy speed accessible from the organize at any given point in time, subject to the components counting but not constrained to the over which will not be straightforwardly controllable by CGNET.

J. The customer agrees to pay all amounts due under this agreement.

2. SERVICE & PACKAGES.

A. Internet package price includes Telecommunication Service Charge and Basic Support Services.

B. Payment: The customer agrees to pay all amounts due under this agreement.

C. Package Upgrade: Customer may update their package within the center of their subscription in any case; however, charges will apply.

D. Service Contract: Service contract stays substantial until the service/package validity.

E. Service Transfer: Service is only provided for the use of the Customer and it may not be transferred to any other without prior written request of Customer and CGNET. The same Service Transfer Charger will be applicable as per the policy.

F. Service Re-activation: Standard Re-activation charges will be applicable if the Customer chooses to re-activate the service after service expiration.

G. Data usage: Data usage will be calculated as the sum of total data consumed. Unused data will not be carried over to the next renewal.

H. Relocation charges will be applicable as per current company policy. The customer shall provide at least 7 working days prior notice for relocation.

I. CGNET will use its best endeavors to notify the customer in advance of any maintenance and repairs which may result in the unavailability of a service, but cannot always guarantee this.

J. Service Hold (Pause) of our services is not available for now.

K. Service Termination: If the Customer does not renew the package for more than a week after the service package expiration, CGNET reserves the right to terminate the service and disconnect the physical fiber connection.

L. Service will automatically be discontinued if CG network detects any malicious activities from your devices. The discontinuation will be valid for various illegal activities and if used for fraudulent cases or cyber-crimes according to the Electronics Transaction Act 2063 or the NTA guidelines.

M. The company will provide prior notices in case of any Service maintenance activity / Technical glitch.

3. SUPPORT SERVICES

A. CGNET shall provide Customer Care support from 6 AM to 10 PM via telephone and Email.

B. On-site field Support will be provided to the customers within 48 hours. Additional charges may apply as per company policy for equipment/parts, fiber cable, and accessory replacements.

C. Service Demarcation Point: The service demarcation point is the ONU Device provided by CGNET. CGNET shall be responsible for internet connectivity up to the Service Demarcation Point only.

D. Installation/Setup: CGNET shall provide a one-time setup and primary router configuration service.

4. EQUIPMENT OWNERSHIP & WARRANTIES.

A. Installation Process: customer will provide CGNET/personnel access to their premises for installation, and service maintenance regards. Customer must have necessary permissions from any party if required for the installation process.

B. CGNET will not be responsible for beautification during the cable installation process for both fiber and Ethernet on-site.

C. Cable charges and installation charges will be applicable as per company policy.

D. ONU (Optical Network Unit)/Router devices provided to the customers are CGNET property. The refundable deposit will be returned to the customer after working ONU device with original receipt is returned to the company.

E. ONU/Router carries 6 months warranty against manufacturing and software defects. Any damage caused to a device by activities not covered by warranty is chargeable at the full price of the device.

F. Any equipment installed at customer premises shall remain the property of CGNET. Equipment under CGNET ownership if damaged, mishandled, destroyed, lost, or stolen while in customer’s premises, the customer shall be liable for the cost of repair or replacement of the equipment.

G. If the service is terminated for any reason, CGNET shall uninstall and take back its belongings from the customer’s premises. The customer agrees to provide CGNET unhindered access to uninstall the equipment within its premises for this purpose. If equipment is not returned within twenty-one (21) calendar days or is returned damaged, the customer will be charged in full for the equipment.

5. REFUND POLICY.

CGNET poses no refund policy for payments other than the deposit amount collected for devices provided to the Consumer upon return in working condition.

6. FAIR USAGE POLICY.

Fair Use Policy is aimed to ensure we provide a quality internet experience to all our customers. Massively consumed bandwidth can cause network congestion, and result in slow down the speed to keep everyone connected.

CGNET reserves the right to significantly reduce internet speed without notice as well as restrict.
